Jul 3 2025 9:08pm We asked Property Management for an update on outstanding queries, some of which date back to April:
1) Please clarify the capacity from which you respond.
Please can you confirm if you are answering the below a) on your own behalf, b) on behalf of Property Management, or c) on behalf of the Board of Directors, whose contact info we asked for back on May 15 2025 10:10pm that you have yet to provide. It is important for us to clarify this point since the Noise Bylaw contains wording that "An Owner or Occupant SHALL NOT: make or permit noise in or about any Unit or the Common Property, allow any odour to emanate or escape from their Unit or conduct himself in any manner, or obstruct any sight line which, in the sole opinion and discretion of the Board, constitutes a nuisance or unreasonably interferes with the use and enjoyment of a Unit or the Common Property by any other Owner or Occupant." We need to understand clearly on whose behalf you have a) decided the months of ongoing noises do not come from [Unit above us] and that b) the sounds of bathroom noises that we continue to hear are deemed acceptable and not an indicator of potentially unapproved sub-standard soundproofing.
2) Children Visiting in an Adults-Only Building
Please can you provide an answer to the question we raised Apr 4 2025 9:27am about what happens when children visiting this Adults Only Building make unacceptable noise. You said you would reply once you "get to know the property and history a bit more", and you have had over 3 months now to get to know the property and history a bit more.
3) Our Request for Contact Info for the Board
Please provide contact details for the Condo Board, as we requested from you on May 15 2025 10:10pm and again on Jun 1 2025 4:18pm under Ticket Ref 3406906. Otherwise please confirm that you act and respond on behalf of the Board, so we can understand the ramifications and impact this may have relating to the upcoming Board Elections later this year.
4) Renovation Approval for Flooring in [Unit above us]
You advised back on May 16 2025 5:05pm that you would look into the information you were given from the previous management company to see if there was any renovation done in units above us and surrounding. Please can you provide an update on this. We have had to source photos of [Unit above us] to send you, which is concerning that records are not more accurate. As well, if the bedrooms of [Unit above us] are now laminate, this means it was installed after 2021 and thus there should be easily-accessible written records of Board approval for this renovation. We await the further update you mentioned on Jun 5 2025 1:31pm when you said you would speak to the rental agency handling [Unit above us] relating to the flooring type and update again next week. The "update next week" was incomplete as it did not confirm the renovations were done with attention to sound attenuation and with the written approval of the Board. It also did not contain information about the floor covering (carpet or wood) in the bedrooms specifically, as it may be different from the photos of the unit we had to source ourselves to assist your investigation. We are not renters who have a self-interest in claiming to be quiet while our shouting matches are heard from the hallway outside of [Unit above us]. We are owner-occupiers of our Unit, as are most residents of the building. Owner-occupiers have a higher and longer-term financial and emotional investment in our homes.
5) Renovation Approval for Units Above Us and Surrounding
We await the update about renovations done on "units surrounding" you advised you'd look into on May 16 2025 5:05pm. Since you have (in a capacity you will hopefully clarify from point #1) unilaterally decided the noise is not coming from the renters in [Unit above us]. Nevertheless, the noise persists, and you told us that [Unit above us] also claims to hear it, so the noise may be coming from elsewhere. We asked you on Jun 1 2025 4:18pm under Ticket Ref 3406906 for confirmation that the flooring installed in [Unit above us] and surrounding was done with written consent of the Board and was found to meet the required specifications for elements of sound control and attenuation. We continue to hear stomping, running, and bathroom sounds loud enough to recognize them as urination from a standing position. We have doubts about the quality of soundproofing done during renovations, and the fact that it has taken you and/or the Board months now to confirm that renovations were approved is concerning us. Is there inadequate record-keeping as well as substandard soundproofing? You then advised us on Jun 6 2025 1:42pm you would "check if the previous property management company sent you records of previous renovation approvals and you will also be asking Board Members regarding this, as they should have information if nothing was passed along to yourselves". Please can you advise where the blocker is? Have you checked your records yet? Did you not receive records from the previous property management company? Did you ask Board members regarding this? Do the Board not keep adequate records? It is very concerning that simple paperwork is not readily available to confirm adherence to the Bylaws relating to approval for renovations.
6) Noise Issues Brought to the Board's Attention
You advised back on May 16 2025 5:05pm that if noise continues to be an issue, you will bring it to the Board's attention. We asked you again Jun 1 2025 4:18pm under Ticket Ref 3406906 if you had passed the noise complaint details to the Board. The noise continues to be an issue. You have decided that a general notice to all residents cannot be sent out (even though you CAN send a general notice about the garbage chute). The Board has sole discretion about what constitutes a nuisance or unreasonably interferes with the use and enjoyment of a Unit or the Common Property by any other Owner or Occupant. Please confirm if you have brought the noise issue to the Board's attention yet. We would like to understand at what level the ongoing noise issues and concerns about soundproofing are being stalled, as it can relate to the Board elections coming up later this year.
7) Construction Taking Place Outside Hours Permitted by Bylaw
You advised us on Jun 6 2025 1:42pm that if renovation work is taking place outside of the acceptable hours, you will speak to the unit once you confirm which unit it is. This relates to the construction noise happening out of hours heard across 2 entire floors of the building reported to the Concierge on Jun 4 2025 at 6:15pm who knows which Unit it was as they had 1 construction person on site who had not yet signed out. You then said again on Jun 18 2025 10:27am that you will check with the Concierge as to who was working construction after hours, and confirm the hours, etc. Please advise if you have been able to liaise with the Concierge to confirm which Unit it was and what (if anything) has been done, as it has been almost a month now.
8) Garbage Chute Being Used Outside Hours Permitted by Bylaw
Please provide an update on your statement of Jun 13 2025 9:55am that you would add the Garbage Chute times to the notice. It is now (Jul 3 2025) over 2 weeks later and the paper taped to the Chute doors still does not contain Hours of Operation. We have raised today (Jul 3 2025) Ticket 3634642 to flag 3 more instances of the Garbage Chute being used out of hours. Is there a timescale you can provide to change the printout taped to the door to add the Hours? The paper note contains a "threat" that the doors would be locked if the Chute is not used properly, which confirms that it is possible to lock the doors. Why can't the Garbage Chute door be locked out of hours to immediately resolve the ongoing issue?
9) Logic Surrounding General Notice that CAN be Sent Regarding Garbage Chute Hours
Please can you reply to our query asking for more details around the logic of you saying on Jun 18 2025 11:39am that you CAN send out a reminder about the Garbage Chute times, despite not knowing exactly which Unit(s) keep using the chute out of hours (even though no evidence of such a notice, or even evidence of the physical notices being replaced has been found), but you can NOT send a general reminder to all residents about the ongoing stomping and banging noises that have persisted for months now and been much more frequent and longer lasting than the occurrences of the Garbage Chute being used. It seems illogical for me to have to investigate individual units when noise is happening after 11pm yet when the Garbage Chute is being used out of hours, you CAN somehow send a general reminder (even though this doesn't actually seem to have been done yet, weeks later.) Why can't the Garbage Chute door be locked out of hours to immediately resolve the ongoing issue?

If you and/or the Board have decided that the ongoing stomping and running and bathroom sounds we continue to hear are acceptable, we would like to use the same underlay as being used by [Unit above us] and the units above and surrounding in order to match the quality.

West Tower Garbage Chute continues to be used outside of the Hours of Operation permitted by Bylaw (8am-10pm). This was first reported over a month ago and Community Manager advised June 13 2025 9:55am she would put the permitted hours on the doors. This has not been done yet.
Even further instances of the chute being used outside the hours permitted by bylaw since the last ticket raised (3634642 raised July 3 2025) are:
On July 8 we were told the Community Manager would reach out to us that day regarding ticket 3634642 and that she would "also be sending a more detailed update to all residents about the garbage chute and hours of operation." No one has reached out to us — not that day, and not the next day. The "detailed update to all residents" has not been sent out. Nothing has been done at all.
It's been sounding like loose construction materials have been thrown down the chute for days now. There are pieces of drywall and evidence of construction on the carpeting right outside of [ 2 floors up and to the left ].
Property Management were asked July 3 2025 9:08pm why the Garbage Chute cannot be locked out of hours to immediately resolve the ongoing issue. No response received as yet.

We suggested there should be a written approval from the Board for the modification from carpeted flooring, with considerations for sound control and attenuation. We also said there was no specific time where construction sounds would be inconvenient for us to hear. Condo Bylaw Section 62 E (d) (x) is clear that any owner who receives approval for construction agrees to ensure that all renovations are done between the hours of 8am and 6pm Monday through Saturday (excluding statutory holidays). We suggested it is reasonable to expect that owners respect the times attached to the approval for construction. We advised that the Concierge desk should know which unit on [2 floors above us] is responsible for the Bylaw infraction of this night, as she was in contact with the unit whose contractor was still on site making noise heard across at least 3 floors past the 6pm required construction cutoff time.

Concierge said she would go knock on the door for [Unit above us], find out what was going on, and phone us back.
8:05pm Concierge phoned us to say she went to check and the 2 women in [Unit above us] said they were having dinner. We visited the Concierge desk to share the noise complaints log document explaining we had been hearing unreasonable noise since February 2025 and logging specific occurances since May 5 2025. She advised we were best to speak with another Concierge who will be on duty tomorrow morning.

"If you send me the unit number, I will write a friendly reminder to the unit of the Bylaw regarding noise. Maybe I can find out how often they would have a child on site. Keep in mind, though, that there is not much that can be done about noise when a young child is on site. They are not to run and scream in the hallways, but should you hear them through the walls, we can only advise the unit and see what they can do. Children will always be noisier than an adult. If this continues to be an issue, I will bring it to the Board's attention."
Property Management also said "I will look into the information we were given from the previous management company to see if there was any renovation done in units above you and surrounding. If they never changed their flooring, then they would have the right underlay, as all units should have the original cork under their vinyl which holds the correct ratings. However, I will look into this to see if any renovations were done and the correct floor specs adhered to."
It is noteworthy that the Property Management company of an Adults Only building has such a lack of understanding that people who live in this Adults Only building have an expectation that other residents will not permit visiting children to cause a disturbance, interfere with the comfort of other occupants, or otherwise breach anyone's right to quiet enjoyment of their residence.

We advised that the start of this ongoing unreasonable noise leads us to question whether there has been a renovation done with inadequate soundproofing insulation installed, or a new resident who does not consider others who live in this building, or perhaps both.
We specifically asked for confirmation that the unit above us, and those adjoining, had floor soundproofing insulation that met the Board-required specifications.

Since this this is an Adults Only Building, where children are pemitted to visit, we enquired what happens when the children visiting make unacceptable noise?
We had not been logging each noise issue since we had hoped the issue would resolve itself, but this did not happen, so we had to begin making logs of all issues.

An Owner or Occupant SHALL NOT: except in the entrance way, kitchen and bathrooms of their Residential Unit fail to keep all floors in their Unit covered with wall to wall carpet or hardwood flooring with properly installed acoustic underlay without the express, prior written consent of the Board which shall, amongst other things, consider elements of sound control and attenuation with respect to any proposed floor covering variations;
An Owner or Occupant SHALL NOT: make or permit noise in or about any Unit or the Common Property, allow any odour to emanate or escape from their Unit or conduct himself in any manner, or obstruct any sight line which, in the sole opinion and discretion of the Board, constitutes a nuisance or unreasonably interferes with the use and enjoyment of a Unit or the Common Property by any other Owner or Occupant. No musical instrument, audio system, power tool or other device shall be used within a Unit which in the opinion of the Board causes a disturbance or interferes with the comfort of other Owners or Occupants. No workmen or contractor shall be permitted to do any work in any unit that would disturb any other Owner or Occupant;
The Owner requesting such approval agrees to: ensure that all renovations are done between the hours of 8:00 a.m. and 6:00 p.m. Monday through Saturday (excluding statutory holidays), and shall comply with all Municipal noise bylaws and ensure that all renovation activities are confined to the Unit and do not affect any part of the Common Property;
